Judgment

The present third bail application has been filed under Section 439 Cr.P.C. The petitioner has been arrested in connection with FIR No.326/2020 registered at Police Station Deoli, District Tonk for the offence(s) under Section(s) 8/18 of the NDPS Act.
It is contended by learned counsel for the petitioner that his second bail application was dismissed by this Court vide order dated 23.04.2021 with a direction to the learned trial Court to expedite the trial of the case; but, not in a single prosecution witness examined so far. He relies upon order sheets of the learned trial Court placed on record for perusal of this Court. He, therefore, prayed for release of the petitioner on bail.
Learned Public Prosecutor has opposed the bail application.

At present, this Court is not inclined to extend the petitioner benefit of bail in view of nature and gravity of allegation against him. However, he shall be at liberty to renew the prayer for bail if the trial is not concluded within a period of six months from the next date fixed before the learned trial Court, i.e., 28.03.2022.
The Registrar (Judicial) is requested to intimate the learned trial Court accordingly.
The third bail application is dismissed accordingly.
