Judgment
The present bail application (temporary suspension of sentence) has been preferred with the submission that the cousin of the appellant had expired on 06.06.2023 and he ought to be released on bail to attend the last rites of his cousin brother.
A perusal of the record shows that the brother who is alleged to have expired on 06.06.2023 was the cousin of the present appellant. It is not the averment of the appellant that there is no other person available in the family to perform the last rites of the deceased. Further, the third bail application as preferred by the appellant is also pending adjudication before this Court. The offence qua which the appellant has been convicted pertain to Sections 302 and 201, IPC.
In view of the above facts and the fact that the offences are of grievous nature and the reason mentioned in the present bail application do not survive as of date, this Court is not inclined to entertain the present bail application (temporary suspension of sentence) and the same is therefore, dismissed.
