Cause shown is sufficient. The order dated 26th March, 2021 is recalled. The appeal is restored to its original number. The review application is
allowed.
An impleadment application has been filed on behalf of SEBI praying that the liquidator appointed by the Court in M/s. ABG Shipyard Ltd. be
impleaded as a party in these proceedings. The learned counsel for the appellant has no objection to the impleadment of the aforesaid entity.
Accordingly the impleadment application is allowed. Necessary corrections shall be carried out in the array of the parties in the memo of appeal within
ten days from today.
Issue notice to the newly impleaded party by registered post acknowledgment due. Steps to be taken by the appellant within ten days. List this
matter for admission on 26th July, 2021 by which time the newly impleaded party may file the reply.
Parties are directed to contact the Registrar 48 hours before the date fixed to find out as to whether the hearing would take place through video
conferencing or through physical hearing.
The present matter was heard through video conference due to Covid-19 pandemic. At this stage it is not possible to sign a copy of this order nor a
certified copy of this order could be issued by the registry. In these circumstances, this order will be digitally signed by the Private Secretary on behalf
of the bench and all concerned parties are directed to act on the digitally signed copy of this order. Parties will act on production of a digitally signed
copy sent by fax and/or email.
