Judgment
A.N. Venugopala Gowda, J.—Learned Addl. Government Advocate takes notice on behalf of the Respondents.
Heard the learned Counsel on both the sides and perused the writ petition papers.
Against the refusal to grant an interim order prayed in the application filed before the Karnataka Administrative Tribunal, the Petitioners have approached this Court for relief. While ordering notice to the Respondents, this Court has recorded as follows :
The material on record disclose that these Petitioners are promoted from the cadre of Junior Training Officers to the Training Officers by order dated 10.1.2008. It is not in dispute that without notice to them an order of reversion has been passed. It is that order of reversion which is challenged by the Petitioners before the Karnataka Administrative Tribunal.
Though the Tribunal notices these undisputed facts, it has declined to grant an interim order on the ground that such an interim order would run counter to the orders passed in connected proceedings. That is not a ground for declining an interim order. In those circumstance, the matter is to be taken out of turn, heard expeditiously and appropriate directions have to be issued, Otherwise, the valuable right, if any of the applicant would be defeated though they have availed the remedy available to them.
In that view of the matter, the order of reversion dated 26.7.2010 and all further proceedings pursuant to the same are stayed for a period of one month.
Issue emergent notice.
(Underlining is by us)
The purpose for which the writ petition was filed has been served on account of the aforesaid order.
Directing continuance of the interim order till the disposal of the applications filed before the Tribunal, the writ petitions stand disposed of.
The Tribunal to consider the applications and dispose of the same on their merit, keeping in view the observations noted supra.
