Judgment

Learned counsel for the petitioners has produced in Court today, a copy of an order passed by this Court (co-ordinate Bench) on 30.09.2019 in CRM-M-41913-2019, disposing of that petition, with a direction that the petitioner would surrender before the learned Additional Sessions Judge and furnish fresh bail bonds and surety to the satisfaction of that Court, within a period of 10 days of 30.09.2019.
The order impugned in the present petition, dated 11.07.2019, has been passed by the learned Additional Sessions Judge, Ludhiana, forfeiting the bail and surety bonds of the petitioner, to the State, he not having come present on that date before that Court.
The matter actually pertains to a complaint instituted by the respondent under the provisions of Section 138 of the Negotiable Instruments Act, 1881, in which the petitioner was convicted by the trial Court with him being in appeal before the appellate Court, i.e. the Additional Sessions Judge.
That being so, this petition is also disposed of with a similar direction as has been given in the order passed in CRM-M-41913-2019, to the effect that upon the petitioner surrendering before the learned appellate Court with in a period of 15 days from today, he would be admitted to bail to the full satisfaction of that Court, upon him furnishing fresh bail and surety bonds, and also furnishing an affidavit to the effect that he would never remain absent on any subsequent date of hearing, except with the express permission of that Court.
