Judgment
Heard Sri P. N. Sharma, learned counsel for the petitioner, learned Standing Counsel for opposite party No.1, 2 and 3 and Sri Vinay Bhushan for opposite party No.4.
The claim of the petitioner is that he has obtained B.Ed. degree from Kargil Sahid Mahavidyalaya, Jaswant Nagar, Etawah, which has been given recognition by the NCTE in the year 200405, copy of the recognition by NCTE has been annexed as annexure No.4 to this writ petition. It is his case that opposite partyNo.3District Institute of Education and Training, Sultanpur has refused his B.Ed. degree on the ground that this college was not recognized by the NCTE. Learned counsel for the NCTE confirms that the Annexure No.4, which is the recognition by the NCTE is very much valid.
There appears to be some factual misunderstanding which at best can be resolved by the authorities itself.
Let the petitioner file a fresh representation along with copy of the recognition of NCTE dated August 4, 2004. The representation so made shall be decided by opposite party No.2Director, State Counsel of Educational Research and Training, Lucknow within a maximum period of two weeks from the date a certified copy of this order is produced before him.
With this direction, the writ petition stands finally disposed of.
