It is known to the people of State of Rajasthan that there is a project "Suddatha Ke Liya Yuddha" and facts of this case will show that how the public at large is suffering because of collusion in between the persons who are responsible to prevent the food adulteration with the persons who are engaged in the food adulteration.

The appellant was SHO at relevant time and was posted at police station Khanda Phalsa, Jodhpur, and allegations and findings recorded against him in brief are quoted here from the order of the Inspector General Police, Jodhpur Range, Jodhpur dated 17.5.2008:

In this way the order of punishment of only stoppage of one annual grade increment without cumulative effect was altered to punishment of censure only.

The facts which are not in dispute are that the petitioner was incharge of police station Khanda Phalsa. In a raid adulterated Ghee was recovered from the factory and not from the shop. Only 2 Kg. of sample was taken and rest of the Ghee was not recovered inspite of the fact that petitioner, in the capacity of the SHO of police Station concerned, was present on spot. The allegation is that instead of doing investigation himself, he got investigation from his junior officer and during this investigation, the petitioner SHO of the Police Station, remained present on the spot. Against the same factory, three more cases were registered on earlier occasion of adulteration and information about these three earlier cases of food adulteration was not given to the court concerned. The defence taken by the petitioner was rejected by in departmental enquiry yet it has been held that there was no ill motive of the petitioner.

Learned Counsel for the petitioner pointed out that in the departmental inquiry and in report dated 30.3.2007, the findings have been recorded against Sh. Nathu Singh Sub-Inspector of the same police station, Dy. Inspector Madha Ram of the same police station, Rajendra Singh Sub-Inspector of the same police station, Shivlal Salvi the police inspector, Dhagla Ram Inspector Police, Moolchand Vyas Food Inspector, Lokesh Sonwal Dy. Superintendent of Police and all were found guilty.

According to learned Counsel for the petitioner the petitioner alone has been punished with the punishment of censure whereas none of the other person has not punished in any departmental inquiry.

I would like to incorporate the findings recorded by the enquiry officer against all named persons in the inquiry report dated 30.3.2007 so that all may know that what were the allegations against these persons.

In the presence of CO. and SHO, food adulteration in large scale was found four times from same premises and on...occasions the C.O. and SHO were present on the spot and they had knowledge of earlier three cases of food adulteration in in large scale but they remained silent spectator for non-recovery of adulterated Ghee and they have been found guilty in of adulterated Ghee and they have been found guilty in preliminary inquiry and petitioners pleas were rejected even up to appeal and yet he has been certified of having no ill motive in all these transactions then what for he was asked come on spot? Why he did not inform to court about three already pending cases of the food adulteration against the same accused? Why did not registered the case for offence u/s 420 IPC? Then there appears no reason for punishing anybody even for heinous crimes. The offence of adulteration of food has been made punishable with minimum sentence. The State itself found necessary to start the Abhyan known as "Suddatha Ke Liya Yuddha" thus they one can understand that the grievance of the public against the large scale food adulteration has reached to the Government but look at the action taken in this case against the officers, investigating or officers supervising and who are punishing for such misconduct is unfortunate. The facts stated in the impugned order and fact which are not in dispute and referred above, compels this Court to send copy of this order to the Chief Secretary of Government of Rajasthan, who may see that how the things may happen in such offence against the public and human being and towards the coming generation.

On merit, I do not find any ground in this petition. Hence, the writ petition is also dismissed.
