Heard Ms. Harneet Kaur Khanuja, learned counsel for the applicant and Shri Ramakant Mishra, learned counsel for the respondents.

Learned counsel for the applicant submits that the applicant through this OA, is seeking consequential benefits. However, he has not filed any representation regarding grant of consequential benefits before the respondents and has approached this Tribunal directly.

Learned counsel for the respondents submits that as the applicant has not availed the remedy before the respondents and has approached this Tribunal, hence the OA may be dismissed as premature.

After hearing learned counsel for both the parties I am of the view that first the applicant may file a representation before the competent authority amongst the respondents regarding grant of consequential benefits. If his grievance does not get redressed by the respondents then he may approach this Tribunal.

In view of the above observations the OA is dismissed as premature. No cost.
