Shiv Kumar and Another vs State of Haryana and Others

Ajay Tewari, J.—The claim in the present petition is for interest on the alleged delay in disbursal of retiral dues. The petitioner No. 1 retired on 31.01.2008 and the petitioner No. 2 retired on 31.05.2008. From the record it is clear that the petitioner No. 1 submitted his pension papers on 07.01.2008 and the petitioner No. 2 submitted his pension papers on 31.03.2008 whereas as per instructions they were supposed to submit the same six months prior to their retirement. From the details of the payment made, learned counsel has argued that some payments were made after more than one year. In reply it has been mentioned that these payments fell due to the petitioners only on account of pay revision which took place in the year 2009 and their case for revised pension was also forwarded to respondent No. 3 so, there is no delay on their part in that regard too because the option proforma was submitted by the petitioners on 29.08.2009 and 8.7.2009 respectively which was mandatory for releasing the revised benefits. No replication has been filed to this reply of the respondents. In these circumstances it has to be held that there is no such delay which would entitle the petitioners to interest.

Petition is dismissed.
