This is third application filed under Section 439 of Cr.P.C. for grant of bail.
The applicant has been arrested on 12.07.2020 in connection with Crime No.15/2020 registered by Police Station Picchore District Shivpuri for offence punishable under Sections 427, 436, 456, 147, 294 of IPC.
It is submitted by the counsel for the applicant that according to the prosecution case, the applicant and other co-accused persons had attacked the houses of the members of a particular society thereby causing loss of rupees thirty-forty lacs. Although the second bail application of the applicant has already been dismissed by order dated 12.01.2021 passed in M.Cr.C. No.49919/2020, but the present application has been filed on the ground of period of custody. However, it is also submitted by the counsel for the applicant that the bail application of the co-accused Natiraja has already been dismissed by this Court by order dated 29.08.2020 passed in M.Cr.C. No.29738/2020 and SLP filed by Natiraja which was registered as SLP (Cri.) No.4591/2021 has also been dismissed by the Supreme Court.
In view of the allegations made against the applicant as well as in view of the dismissal of the SLP filed by Natiraja, no case is made out for grant of bail.
The application fails and is hereby dismissed.
