The instant revision has been preferred by the petitioner/defacto complaint praying for expeditious disposal of G.R. Case No. 797 of 2018 pending before the learned Chief Judicial Magistrate, Hooghly, after splitting of the case.

It is submitted by the learned advocate appearing for the petitioner that in the month of February 2018, petitioner initiated a case of murder against the opposite parties for causing death of her husband which has culminated in charge sheet against the opposite party nos. 2 to 14 showing the opposite party nos. 9 to 14 as absconders and till date they have not yet been arrested, though warrant is pending against them.

He further submits that this Court while disposing the bail application of opposite party no. 2 under Section 439 of the Code of Criminal Procedure November 26, 2018 in CRM 9714 of 2018 directed the learned Court below to ensure the attendance of the absconding accused persons and in the event their attendance cannot be ensured in spite of exhaustion of all processes, declare them as proclaimed offender and commit the case to the Court of Session at the earliest without unnecessary delay.

He further submits that in compliance of the direction of this Court learned Court below has already issued W.P.A against those accused persons declaring them as proclaimed offenders.

Having considered the submission of the learned advocate appearing for the petitioner and without entering into the merit of the case, I dispose of the instant revision requesting the learned Court below to take earnest endeavour for expeditious disposal of the case after splitting of the case record against the absconding accused persons if the occasions so arises.

Since no affidavit in opposition is called for from the opposite party, the allegations made herein are deemed to have not been admitted by the opposite party.

The instant revision being CRR 3122 of 2018 is thus disposed of.
