Petition filed under Section 482 Cr.P.C.

The petitioner is the 1st accused in SC No.562/2016 on the file of the Sessions Judge, Palakkad. He along with the co-accused is alleged to have committed the offences under Sections 307 and 302 r/w Section 34 of the Indian Penal Code. The case was posted to 03.07.2017 for examination of four witnesses. On 29.06.2016, his counsel relinquished the vakalath. So, on 04.07.2017, he requested the court to give him an adjournment to engage a counsel. The court granted the request, but, directed him to pay 1,000/- each as costs to the four witnesses. It posted the case to 11.07.2017 for examination of those witnesses after they were bound over. The prayer in this Crl.M.C. is to direct the court to grant the petitioner sufficient time to engage a counsel.

Heard the learned counsel for the petitioner and the learned Public Prosecutor.

The petitioner was informed of the relinquishment of the vakalath by the former counsel on 29.06.2016. Now the case stands posted to 11.07.2017. The time granted by the Sessions Court appears to be reasonable. No direction can be issued to the trial court to give him a distant posting of the case.

In the result, the Crl.M.C. is dismissed.
