Ravi Malimath, J

1.

This petition is filed on the ground that the order passed by the learned Single Judge in Writ Petition (Crl) No.2112 of 2019 dated 29.11.2019 has

been disobeyed by the respondent.

2.

Subsequent to the order passed by the learned Single Judge, the answering respondent has directed the C.O. Kotdwar to setup an inquiry against

respondent no.3 in Writ Petition (Crl) No.2112 of 2019. A detailed inquiry has been conducted by the C.O. Kotdwar and after concluding the inquiry,

the C.O. Kotdwar submitted the inquiry report stating that no irregularity or illegality has been committed by the erring officer. The same has been

accepted by the respondent herein, as is clear from annexure-1 to the counter-affidavit.

3.

We do not find that any contempt has been committed by the respondent, since the order passed by the learned Single Judge was to take an

appropriate action, and the appropriate action has been taken. Hence, nothing further survives for consideration.

4.

The petition is, accordingly, dismissed.
