The petitioners seek quashing of FIR No. 649/2016 of PS Vasant Kunj for offence under Section 498A/406/34 IPC and the proceedings arising out of the same. It is stated that petitioners have settled all disputes with the complainant de facto (respondent no. 2 herein). All three petitioners and respondent no. 2 have personally appeared in Court, identified by IO/SI Ram Pratap Yadav.
I have spoken with the parties. It is stated by them that petitioner no. 1 and respondent no. 2 have got their marriage dissolved by way of decree of divorce with mutual consent and they have decided that custody of their only daughter shall remain with the present respondent no. 2, with visitation rights for petitioner no. 1 in accordance with the detailed terms recorded in mediation settlement dated 29.08.2024 recorded at Delhi Mediation Centre, Patiala House Courts, New Delhi. Respondent no. 2 submits that she has received the complete full and final settlement amount in lieu of her stridhan and alimony. Respondent no. 2 submits that she does not wish to pursue the prosecution of petitioners in the interest of their child.

Having spoken with both sides I am satisfied that it would be in the interest of justice and permanent quietus that parties be not pushed through trial.
Therefore, the petition is allowed and accordingly, the FIR No. 649/2016 of PS Vasant Kunj for offence under Section 498A/406/34 IPC and proceedings arising out of the same are quashed. Pending application stands disposed of.
