This writ petition is filed by the petitioner being aggrieved by non-consideration of the application filed under Section 167(2) of the Cr.P.C. before

the Principal City Civil and Sessions Judge at Bengaluru and also before the Chief Metropolitan Magistrate at Bengaluru.

Learned Senior Standing Counsel Sri Jeevan J. Neeralgi, appearing for the respondent submits that the grievance of the petitioner is that in view of

the respondent’s failing to file the final report within the statutory period of 60 days, an application under Section 167(2) of Cr.P.C. is said to have

been made by the petitioner seeking default bail. However, the learned counsel for the respondent would further submit that in view of the lockdown

declared by the State Government, the respondent was not able to submit the final report. It is further submitted that final report is ready and the same

will be submitted before the Trial Court if permitted and a direction may be issued by this Court.

Having heard the learned counsels, this Court is of the considered opinion that the ends of justice would be met, if the respondent is directed to file

the final report before the trial court on or before 27.04.2020. The trial court is directed to take up the application for bail filed by the petitioner at the

earliest and not later than 05.05.2020 and pass orders on the application made by the petitioner seeking bail.

Petition stands disposed of accordingly.
