The petitioners are accused in Crime No.254/2019 of Kasaragod Police Station registered for the offences punishable under Sections 364A, 324, 342 and 323 IPC.

The petitioners were arrested on 21.04.2019 and ever since they have been in custody.

The learned Public Prosecutor has submitted that the petitioners are not involved in any other offence of similar nature. It appears that there was dispute between the brother of the victim and the 2nd accused in respect of some money transaction. The learned counsel for the petitioners has submitted that the brother of the victim borrowed an amount of Rs.47,00,000/- (Rupees forty seven lakh only) from the 2nd accused. However, he returned only Rs.9,50,000/- (Rupees nine lakh fifty thousand only). The learned Public Prosecutor has submitted that the recoveries have been already effected.

It appears that the major part of the investigation is practically over. That apart, the petitioners have no criminal antecedent. In the said circumstances, I am of the view that further detention of the petitioners is not necessary in this case.

In the result, this application stands allowed and the petitioners shall be enlarged on bail on condition of each of the petitioners executing a bond for Rs.40,000/- (Rupees forty thousand only) each, with two solvent sureties each, each for the like sum to the satisfaction of the Jurisdictional Magistrate and subject to the following further conditions:-

The petitioners shall report before the Investigating Officer on every Monday between 9 a.m. and 11 a.m. for four months and thereafter, as and when required by the Investigating Officer for interrogation.

2.

The petitioners shall not get involved in any other offence during the pendency of this case.

3.

The petitioners shall not intimidate or influence the witnesses or in any way tamper with the investigation.
