Judgment
The claim of the Petitioner for grant of licence to ply 'Ski Jet Boats' in the Dal Lake in terms of the provisions of the J&K Water Resources (Regulation and Management) Act, 2010 and the Rules framed therein is stated to be pending with the concerned authority, i.e., the Chief Engineer, Irrigation and Flood Control, Kashmir/ Respondent No.5 herein. It is stated that the delay in finalization of the case for issuance of licence, despite repeated requests, has formed a ground for the Petitioner to file the instant Writ Petition before this Court.
Without making any observation or recording any finding with regard to the merits of the case, we, at this stage, grant two days' time to the Petitioner/ Counsel for the Petitioner to place on record the documents which substantiate the fact of the Petitioner having applied before the prescribed authority for grant of licence in terms of the Act of 2010 and the Rules framed therein.
Let the needful be done, as aforesaid, by the next date of hearing in the shape of Supplementary Affidavit, with copy in advance to the Counsel for the other side.
