This application was mentioned by the learned Counsel appearing for the Applicant at 10.30 this morning, projecting extreme urgency in the matter. It was directed to be listed at the end of the admission board today.
By this application, the Applicant seeks to bring to the notice of this Court that the Respondent no. 5 i.e. the Goa Coastal Zone Management Authority (GCZMA) is proceeding to decide the matter as directed by this Court but, in violation of the letter and spirit to the direction given by this Court. It is claimed that if the said Respondent is not restrained from passing any order in the matter during the pendency of the present application, the application itself would be rendered infructuous inasmuch as the said Respondent has kept the matter for further consideration/order on 11.11.2021.
Prima facie, it appears that there is substance in the contention raised on behalf of the Applicant. Accordingly, the application is directed to be listed for consideration on 17.11.2021 before the appropriate Bench.
In the meanwhile, the Respondent no.5-GCZMA shall not pass any order pursuant to hearing conducted on 02.11.2021.
