Judgment
This misc. appeal is directed against the order dated 12.05.2023 passed by Family Court No.2, Jodhpur, whereby the Family Court has rejected the application preferred by the appellant seeking direction from the Family Court against the respondent for producing further material in terms of the directions given by Hon’ble Supreme Court in Rajnesh vs. Neha : (2021) 2 SCC 324.
A perusal of the order passed by the Family Court reveals that the same is interlocutory in nature, qua which appeal under Section 19 of the Family Court Act, 1984 is not maintainable.
In that view of the matter, learned counsel for the appellant prayed that above appeal may be directed to be converted into a writ petition.
In view of submissions made, office is directed to register the present matter as a writ petition subject to appellant/petitioner doing the needful for bringing the said proceedings as required for a writ petition.
So far as the present appeal is concerned, for statistical purposes, the same is disposed of.
