Judgment
T.R. Ramachandran Nair, J.—The Petitioner is one of the persons included in the ranked list, for the post of H.S.S.T (Geography) (Junior), which came into force from 05/04/2010, a copy of which is produced as Ext. P-1.
Going by Ext. P-1 ranked list, 31 candidates were included in the main list. Ext. P-2 is the ranked list for H.S.S.T (Geography)(Senior) wherein 22 candidates have been included in the main list.
The contention raised by the Petitioner is that the Public Service Commission has a duty to prepare a ranked list containing sufficient number of candidates for filling up the available vacancies. Seeking for expansion of the ranked list, the Petitioner and a few others filed W.P.(C). No. 23559/2008 which was dismissed by Ext. P4 judgment.
The complaint raised herein is mainly based on the existence of 36 more vacancies in the post of H.S.S.T (Geography) (Junior) at present. It is pointed out that only one candidate remains in the ranked list for the post of H.S.S.T (Geography) (Junior). It is in these circumstances, the Petitioner has approached this Court seeking for a direction to the Commission to consider the expansion of the ranked list.
Heard the learned Standing Counsel for the Commission. The learned Standing Counsel submitted that in the light of the findings rendered in Ext. P-4 judgment, no relief can be granted in this writ petition. The entire parameters to be adopted in these matters have been laid down by the Full Bench in Ravidas v. Public Service Commission (2009 (2) KLT 295). The facts pointed out by the learned Counsel for the Petitioner will not normally justify the request for expansion of the ranked list since the ranked list was prepared sometime back, based on the details available at that point of time. Therefore, it cannot be said that the Commission had erred in publishing the supplementary ranked list. Any developments as on today with regard to existence of some more vacancies will not be a ground for the Commission to expand the ranked list. The entire aspects were considered by the Full Bench in the decision reported in Ravidas v. Public Service Commission (2009 (2) KLT 295) and unless and until it is shown that the Commission had not acted in tune with the principles stated therein, no orders can be issued by this Court. In Ext. P-4 judgment also, the very same issue was considered and found against. I am not satisfied that at this stage this Court can issue a direction to the Commission to take note of number of vacancies as 36, as it exists today, and expand the ranked list even though it is pointed out that there is no fresh ranked list in force. The writ petition is dismissed. No costs.
