(Interim Relief Application No. 3471 of 2012)
Heard learned counsel for the petitioner. By means of this writ petition, the petitioner has sought a writ in the nature of mandamus directing the respondent to permit the petitioner for "Pashu Peth" in pursuance to the tender, which was finalized by the respondent.
According to the petitioner, the respondent issued a tender for "Pashu Peth" for the year 2012-2013 and the petitioner also participated in the tender process and was declared successful bidder and subsequently a licence to that effect was issued in his favour for the year 2012-13. After issuance of the permission, the petitioner deposited Rs. 69,500/- before the respondent on 9-3-2012 in lieu of the fee of "Pashu Peth". A copy of the receipt of the said amount has been annexed as Annexure No. 1 to the writ petition.
The petitioner has also submitted an application on 27-3-2012 before the Upper Mukhya Adhikari, Zila Panchayat, Haridwar for redressal of his grievance, which is pending and no decision has been taken so far, therefore, the petitioner has filed the present writ petition.
Learned counsel for the petitioner, during the course of arguments, made a prayer that the ends of justice would be served if a direction be given to the Upper Mukhya Adhikari, Zila Panchayat, Haridwar, to take a decision on the application of the petitioner (Annexure No. 2 to the writ petition) and that the writ petition may be disposed of. Prayer is innocuous.
The respondent is directed to take a decision on the application of the petitioner (Annexure No. 2 to the writ petition) in accordance with law expeditiously, preferably within a period of two weeks from the date of production of a certified copy of this order.
With the above direction, the writ petition is disposed of finally. All pending applications stand disposed of.
