Matter called twice. Learned counsel for the petitioner is absent.
Learned HCGP on instructions submits that the petitioner herein has not appeared before the Trial Court on the dates of hearing and therefore, split-up case has been registered in C.C.No.94/2023 and non-bailable warrant has been issued against him. The present petition is filed by the petitioner seeking relaxation of condition (e) imposed by this Court while enlarging him on bail in Crl.P.No.464/2020 disposed of on 24.02.2020. Condition (e) reads as follows:-
"(e) He shall not leave the territorial limits of the Trial Court without prior permission of the Trial Court."
Considering the fact that the petitioner has not appeared before the Trial Court on the date of hearing and the Trial Court was constrained to register split-up case and issue non-bailable warrant against him, I am of the view that the petitioner is not entitled for the relief sought for by him in this petition at this stage. Accordingly, petition is dismissed.
