Judgment

The petitioner has filed the present petition for quashing of FIR No. 260 of 2023 dated 10.10.2023, registered for the commission of offences punishable under Sections 341, 354-D and 506 of the Indian Penal Code (in short ‘IPC’) at Police Station Haroli, District Una, H.P.. and consequent proceedings arising out of the FIR. It has been asserted that the parties have entered into a compromise between themselves and the FIR be ordered to be quashed based on the compromise.
It has been asserted that petitioner and informant are residents of same village. Now, the matter has been settled between the parties with the intervention of respectable persons of the society, hence, it was prayed that the FIR be quashed based on the compromise. Hence, the petition.
Statement of victim/informant was recorded on 11 08 2025 in which she stated that she had voluntarily compromised the matter with the petitioner without any influence from any person. She does not want to proceed further in the matter as per the compromise and she has no objection, in case the FIR is quashed.
The police have filed a sta us eport reproducing the contents of the F.I.R. and the steps taken d ring course of the investigation.
I have heard learned counsel for the parties and have gone through the records carefully.
In the present case, offences punishable under Sections 341 and 504 are compoundable under Section 320 of Cr.P.C. This Court had already quashed the F.I.R. under Section 354 of IPC in Vidya Devi vs state of Himachal Pradesh & others 2022 STPL 13724 HP, Chaman Lal vs State of .P., Latest HLJ 2023 (HP) (1) 213, Ameen vs State of Himachal Pradesh & others, 2023(1) Him. L.R 375 and Rakesh Verma vs State of H.P. Latest HLJ 2022 (HP) (2) 952 based on compromise. These judgments are binding on this Court.
Therefore, in view of these precedents, the present petition is allowed and FIR No. 260 of 2023 dated 10.10.2023, registered for the commission of offences punishable under Sections 341, 345-D and 506 of IPC at Police Station Haroli, District Una, H.P. and consequent proceedings pending/initiated against the petitioner-accused in pursuance thereto, are also quashed.
Petition stands disposed of in the above terms, so also pending miscellaneous applications, if any.
Parties are permitted to p oduce a copy of this judgment, downloaded from the webpage of the High Court of Himachal Pradesh before the authorities c ncerned, and the said authorities shall not insist on the production of a certified copy but if required, may verify passing of the order from Website of the High Court.
