Counsel for the petitioner seeks more time to effect service on respondent after collecting its fresh address.
Petition is pending since 2017. Perusal of the record shows that sufficient and more opportunity has already been granted to the petitioner to effect service on the correct address. The order sheet dated 23.09.2019 shows that time was sought to file fresh address of respondents. Again after several years the order sheet dated 20.04.2022 shows that time was again sought to collect dasti notice for serving the respondents. The Order dated 02.08.2022 shows that dasti notice was not collected. Again time was sought on 26.10.2022 to collect dasti notice. The Order dated 26.10.2022 may be quoted hereinbelow:
As prayed by Mr. Madhurendra Kumar, learned Counsel for the Petitioner, dasti notice be collected within two weeks. The Registry shall indicate the date of 07.03.2023 as the next date of hearing in the notice.
List on 07.03.2023. Proof of dasti service be filed.
Matter was again taken up on 07.03.2023 showing that dasti was not collected. Opportunity was again granted. Order dated 07.03.2023 is being quoted hereinbelow:
Mr. Madhurendra Kumar, learned Counsel appearing for the Petitioner states that on the ground of some personal difficulty, he did not collect the Dasti Notice.
He prays for a fresh Dasti Notice be issued. Let the fresh Dasti Notice be issued. The Registry shall indicate the date of 18.07.2023 as the next date of hearing in the notice.
