The matter comes upon the 3rd stay petition preferred by the petitioner with a prayer for acceptance of his application form for the posts of Revenue Officer Grade-II and Executive Officer Grade-IV, advertised vide advertisement dated 24.08.2022.
Learned counsel for the petitioner submits that today is the last date for submission of the application form qua the recruitment in question.
In view of the order being passed in the following paras, as an interim measure, it is directed that the form of the applicant Sharwan Kumar Bishnoi would be accepted by the authorities concerned for the posts of Revenue Officer Grade-II and Executive Officer Grade-IV.
Accordingly, the 3rd stay application is disposed of.
The present petition has been filed against the order dated 02.03.2016, whereby the petitioner was debarred from participating in any future examination to be conducted by the RPSC.
On merits of the case, it has been submitted by learned counsel for the petitioner that similar controversy arose in S.B. Civil Writ Petition No.17128/2015 (Smt. Renu Gupta Vs. RPSC Ajmer) which was disposed of vide judgment dated 12/13.04.2017. The judgment dated 12/13.04.2017 was affirmed by the Division Bench of this Court in D.B. Special Appeal Writ\ No.1018/2017 vide judgment dated 30.10.2017.
Learned counsel for the respondents do not dispute that the issue involved in the present writ petition is covered by the decision as passed in the matter of Smt. Renu Gupta (supra). Relying upon the judgment passed in Renu Gupta’s case, this Court while deciding the case of Rajiv Bishnoi Vs. RPSC, Ajmer & Anr (S.B. Civil Writ Petition No.7421/2016), decided on 04.01.2022 held as under: -
“In view of the submissions made, the present writ petition is also disposed of and the impugned order dated 02.03.2016 is set aside. However, the respondent-Department would be at liberty to conduct proceedings against the petitioner in accordance with law after giving him an opportunity of hearing.”
