The writ petition is filed to direct the Debt Recovery Tribunal-II, Ernakulam, to consider and dispose of Ext.P3 application, expeditiously.

Pursuant to the order passed by this Court, the Tribunal by communication dated 14.6.2023, has informed this Court that the petitioner has filed S.A. (Diary No.212/2023) on 10.2.2023. But, the physical copy was produced only on 30.3.2023. Even though defects were noted in the S.A., the defects were not cured. It is only on 8.6.2023 that the petitioner has filed I.A. No.1867/2023 to post the S.A. before the Bench. The matter now posted to 15.6.2023.

Heard; Sri. P.S. Sujeth, the learned counsel appearing for the petitioner and Sri.Sunil Shanker, the learned counsel appearing for the respondents.

The learned counsel appearing for the petitioner submitted that the application now presently stands posted to 19.7.2023.

Having considered the pleadings and materials on record, and taking note of the fact that Ext.P3 application stands posted before the Tribunal on 19.7.2023, I deem it appropriate to dispose of the writ petition.

Resultantly, I order the writ petition as follows:

(i) The Tribunal is directed to consider and dispose of Ext.P3 application, in accordance with law and as expeditiously as possible, at any rate, within a period of two weeks from the date of receipt of a certified copy of the judgment, after affording the petitioner and the respondents an opportunity of being heard.
