Judgment
Mohammad Rafiq, J.—Contention of Learned counsel for petitioner is that the petitioner is willing to deposit the compounding charges of Rs. 17,400/- as per the demand notice of the respondents dt. 03.07.2013 (Annexure-6), and the respondents be directed to restore the electricity connection in terms of the provision of the Electricity Act, 2003. Section 135 of the Electricity Act, 2003 provides for compounding of first offence. The petitioner has requested in writing to the respondents that they have not made any theft and that they themselves have offered that their electricity meter be checked in the laboratory. The checking of the electricity meter has not been done so far. Having regard to the limited nature of controversy, the petitioner is required to approach the Superintending Engineer concerned, who shall direct, on deposit of the compounding charges by the petitioner, restoration of the electricity connection of the petitioner, subject to final order as may be passed on checking the meter, by passing appropriate order within a period of one week from the date of deposit of such amount.
The writ petition is disposed of accordingly. This also disposes of stay application.
