The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 406 and 420 IPC in Crime No.27 of 2021, seeks anticipatory bail.
2.The case of the prosecution is that based on a complaint lodged by one Rabiya Beevi before the Superintendent of Police, Ramanathapuram that on 26.04.2018, she borrowed jewel loan of Rs.1,00,000/- from the petitioner by pledging her 53 grams of gold jewels and when she went to the petitioner's shop for redeeming her jewel, the petitioner is said to have permanently closed his shop.
3.This is the fifth application filed by the petitioner seeking anticipatory bail. In earlier occasion, the petitioner has filed an affidavit of undertaking that he would return the jewels, which were pledged with him to the persons concerned and obtained an order of interim protection. However, he has not returned the jewels as he undertook and subsequently sought permission of this Court to withdraw this petition. Therefore, considering the conduct of the petitioner,this Court, by order dated 11.07.2023 directed the respondent police to secure the petitioner.
4.Today(20.07.2023), when this Criminal Original Petition is taken up for hearing, the learned counsel appearing for the petitioner as well as the learned Government Advocate appearing for the respondents submit that the petitioner has surrendered before the concerned Magistrate Court.
5.Recording the above submission made on either side, this Criminal Original Petition is closed.
