The petitioner through instant petition under Articles 226/227 of the Constitutioon of India is seeking direction to respondents to pay him salary for the period from 23.09.1996 to 24.10.1997.
The petitioner joined Punjab policce as Constable in 1990. An FIR came to be reggistered against him. He was suuspended w.e.f. 23.09.1996. The Trial Court exonerated him, accordingly, he was reinstated w.e.f. 24.10.1997. During period of suspension, he was paid subsistence allowance. He claims that he should be paid full salary for the susspension period because he has been acquittedd in the criminal proceedings. The respondent has rejected his claim on the ground that he was not honorably acquitted whereas he was extended beneefit of doubt, thus, he is not entitled to full salary for the suspension perriod.
The period involved is very smalll and petitioner during the said period was paaid subsistence allowance. Theere is no representation of the petitioner. It apppears that with the efflux of timme, petitioner has lost his interest to pursue the present petition.
Dismissed for non-prosecution.
