Judgment

This Criminal Miscellaneous Case has been filed by the petitioners under Section 482 of the Code of Criminal Procedure, to quash all further proceedings in Crime No.317/2012 of Perumpadappu Police Station, Malappuram, now pending as C.C. No.214/2015 on the files of the Judicial First Class Magistrate Court, Ponnani.
Heard the learned counsel for the petitioners and the learned Public Prosecutor.
In this matter, prosecution alleges commission of offences punishable under Sections 323, 452, 294(b), 506(ii), 427 read with 34 of the IPC.
It is submitted that the matter has been amicably settled and the defacto complainant and the injured persons filed affidavits in this regard.
The learned Public Prosecutor conceded the settlement and recording of statements, in this regard.
Since the matter has been amicably settled between the parties, there is no reason to disallow the prayer for quashment. Therefore, in the interest of justice, I am inclined to allow this petition.
In the result, this Criminal Miscellaneous Case stands allowed and all further proceedings in Crime No.317/2012 of Perumpadappu Police Station, Malappuram, now pending as C.C. No.214/2015 on the files of the Judicial First Class Magistrate Court, Ponnani, stand quashed.
