Judgment
This transfer petition is filed by wife in O.P. (Div.)No.868/2020 pending on the file of Family Court, Kollam. The original petition was filed by respondent/husband.
I heard the learned counsel for the petitioner as well as the respondent.
It is submitted on behalf of the petitioner that she is an unemployee residing within the jurisdictional limits of Family court, Ernakulam. If she is to contest the proceedings before the Family Court, Kollam, she will have to travel long distance of 300 kms from her permanent residence. It is further submitted that she filed M.C.No.14/2021 before Family Court, Ernakulam in which, the respondent has already appeared. Learned counsel for the respondent did not raise any serious objection for transfer of the proceedings to Family Court, Ernakulam.
In the result, transfer petition is allowed withdrawing O.P.(Div.)No.868/2020 pending on the file of Family Court, Kollam and making it over to Family Court, Ernakulam. The transferer court shall immediately transmit all records to Family Court, Ernakulam, which, on receipt of the records, shall issue notice to parties directing their appearance before that court at an early date.
