Applicant Shakir Husain is in judicial custody in FIR No.425 of 2022, under Sections 363, 366, 354, 506 IPC and Section 7/8 of the Protection of Children from Sexual Offences Act, 2012, Police Station Jaspur, District Udham Singh Nagar. He has sought his release on bail.

Heard learned counsel for the parties and perused the record.

According to the FIR, the victim, a young girl of 14 years of age, had left her house on 01.11.2022 for writing an examination, but she did not appear in the examination. Even she did not return on that date back her home.

Learned counsel for the applicant would submit that there are some contradictions in the statement of the witness, but he could not indicate any such statement.

The victim has already been examined at trial. She has stated that it is the applicant, who had called her multiple times, sometimes 84 times in a day, and he compelled the victim to accompany him. He took her at various places, but, subsequently, when the matter was reported to police, he released the victim under the threat that she should not reveal anything to anyone. She has also stated that, in fact, the applicant wanted to molest her.

It is a case of kidnapping by force.

Having considered, this Court does not see any reason, which may entitle the applicant to bail. Accordingly, the bail application deserves to be rejected.

The bail application is rejected.
