Judgment

This writ petition is filed seeking the following reliefs :-
“i) Issue a writ of mandamus or any other appropriate writ, order or direction, setting aside Exhibit P8 Notice No.K.S.B.C./I.A9/7032/2021-22 dated 10.12.2021 issued by the respondent.
ii) Issue a writ of mandamus or any other appropriate writ, order or direction, directing the respondent to stop all further proceedings pursuant to Exhibit P8 notice.”
Heard the learned counsel for the petitioner and the learned Standing Counsel appearing for the respondent.
It is submitted by the learned counsel for the petitioner that the petitioner is aggrieved by Ext.P8 proceedings issued by the respondent, by which, an amount of Rs.6,19,384/- has been ordered to be recovered from the petitioner. It is contended that the petitioner is only a worker and that the crime and occurrence report did not implicate the petitioner in the offence. It is submitted that Ext.P8 proceedings have been issued directing recovery from the petitioner immediately. It is submitted that the facts stated in Ext.P8 are not correct and that the petitioner was not involved in the incident at all.
Having heard the learned Standing Counsel as well, I am of the opinion that since the petitioner is raising only factual disputes with regard to Ext.P8, the matter is to be considered by the Board of Directors of the Kerala State Beverages (Manufacturing & Marketing) Corporation Ltd. In case the petitioner raises his complaint as against Ext.P8 before the Board of Directors within ten days from today, the issue shall be appropriately considered by the Board and an order shall be issued in the matter, after considering the contentions of the petitioner as well. Appropriate orders shall be passed within a period of one month from the date of receipt of the representation as directed above.
Till orders are passed as directed above, the recovery pursuant to Ext.P8 shall be kept in abeyance. The petitioner shall produce a copy of this writ petition along with a copy of the judgment before the Board for compliance.
This writ petition is ordered accordingly.
