Judgment
Soumen Sen, C.J.
This petition has been filed by the parties as a Public Interest Litigation espousing the cause of the drivers of school buses who used to carry children and general public. It is alleged that these drivers do not have any control over the repairs and maintenance of vehicles used by them for the travel. It is further stated that the manufacturers of public utility vehicles as well as the dealers of the same have a contractual responsibility to provide proper maintenance and repairs to the vehicles sold by them.
The allegations are false, fake and not substantial. Moreover, the persons who would be really aggrieved are not before us and it cannot be said that, having regard to their background or capacity, they would be unable to approach this Court.
However, the State must ensure that the provisions of the Motor Vehicles Act, 1988 and all other allied Acts with regard to the vehicles using as school buses, ambulances, contract carriages, etc., are strictly followed and adhered to.
This W.P(PIL) is accordingly disposed of.
