Heard the learned counsel for the petitioners. The grievance of the petitioners is that sufficient opportunity was not given to the counsel for the petitioners to submit the arguments.
I have called for a report from the learned Magistrate. The report would show that sufficient opportunity has been given. There is a time limit fixed by the High Court. At any rate, the case has been adjourned to 3/10/2022 for judgment.
In these circumstances, the court below is directed to give a posting prior to that, to enable the counsel for the petitioners to make further submissions. Hence, this Crl.M.C is disposed of as follows:
(i) The court below shall advance the case and post it on 29/9/2022.
(ii) The petitioners as well as the counsel shall be present before the court below on 29/9/2022.
(iii) The court below shall give an opportunity to the counsel for the petitioners to make further arguments.
(iv) The court below shall also give an opportunity to the Prosecutor for reply after the arguments.
(v) Thereafter, the court below is free to pronounce the judgment either on 3/10/2022 or on any other day.
