The above original petition is filed with following prayers:
“(i) To issue an order commanding the 1st respondent to deposit the award amount under Exhibit Pl award immediately at any rate within a stipulated time.
(ii) To issue an order commanding the 2nd respondent to initiate all necessary steps and recover the amount covered by the Revenue Recovery Certificate issued by the Tribunal for the recovery of the amounts due under Ext P1 award.
(ii) Grant such other and further reliefs as the petitioner may pray for and this Hon'ble Court deems fit to grant in the circumstance of the case.
(iv) Award the costs of the petitioner in this proceedings.” (sic)
The petitioner is one of the claimants in OP(MV) No.2574 of 2009 on the file of the Motor Accident Claims Tribunal, Thrissur. This petition is filed for issuing a direction to the 1st respondent to deposit the award amount covered by Ext.P1 award immediately.
Heard the counsel for the petitioner and the Standing Counsel appearing for the 1st respondent. I also heard the learned Government Pleader appearing for the 2nd respondent.
The Standing Counsel appearing for the 1st respondent submitted that the entire due amount as per Ext.P1 award will be deposited before the Tribunal. The same is recorded. If there is any grievance to the petitioner or the 1st respondent, the parties are free to approach the Tribunal, in accordance to law. The Standing Counsel for the 1st respondent submitted that the amount will be deposited within three weeks from today. The said submission is also recorded.
Therefore, recording the submissions made by the Standing Counsel for the 1st respondent, this original petition is closed.
