This first Criminal Appeal has been filed by the appellant under Section 14-A (2) of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act for grant of anticipatory bail, who is apprehending his arrest in connection with Crime No. 556 of 2023 registered at Police Station Raghogarh, District Guna for offence punishable under Sections 294, 506 of IPC and Sections 3(1) (r), 3(1)(s), 3(2)(v-a) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.
Learned Counsel for the appellant requests to withdraw this Criminal Appeal. He further requests that a direction may be issued to the Investigation Officer/Trial Court to comply with the directions of the Supreme Court in cases of Arnesh Kumar Vs. State of Bihar (2014) 8 SCC 273, Satender Kumar Antil Vs. Central Bureau of Investigation (2022) 10 SCC 51 and Notification No.A/5666/III-2-9/40 Pt-I F.No.15 dated 20/09/2023 issued by High Court of Madhya Pradesh, Jabalpur. Learned Counsel submits that applicant apprehends arrest in violation of guidelines after submission of Final Report before learned Special Judge.

This Criminal Appeal is dismissed with the direction that the Investigation Officer/Trial Court shall ensure due compliance with the guidelines and directions laid down in cases of Arnesh Kumar Vs. State of Bihar (2014) 8 SCC 273, Satender Kumar Antil Vs. Central Bureau of Investigation (2022) 10 SCC 51 and Notification No.A/5666/III-2-9/40 Pt-I F.No.15 dated 20/09/2023 issued by High Court of Madhya Pradesh, Jabalpur. The trial Court is further expected to comply with mandate of law laid down in Para 35 and 43 of judgment of Satender Kumar Antil (supra) and Para 9 and 10 of judgment of Siddharth vs. State of Uttar Pradesh & Another, reported in (2022) 1 SCC 676.
