Through the instant application, the applicant is seeking condonation of delay of 74 days in filing the accompanied application (M.A. No. 2369 of 2019)

for leave to appeal. For the reasons carved out in the instant application and there being no serious objection raised by learned counsel for the

respondents, delay of 74 days is condoned.

M.A. No. 2370 of 2019 stands disposed of accordingly.

Heard learned counsel for both the sides.

Through the medium of the instant application filed under Section 31(2) of the Armed Forces Tribunal Act, 2007, the applicant is seeking leave for

moving Honble Supreme Court against Order dated 28.03.2019 passed in O.A. No. 464 of 2019 and Order dated 29.05.2019 passed in R.A. No. 11 of

2019 in O.A. No. 464 of 2019.

During the course of arguments, Mr. Tarunvir Singh Khehar, learned counsel for the respondents submitted that if one looks at Para 7 of the order

dated 29.05.2019 passed in R.A. No. 11 of 2019 in O.A. No. 464 of 2019, the applicant had made a prayer for grant of waiver for appearing in the

CEE in March, 2020, but the applicant has not made any representation till date in this regard. He further submits that it may be taken as a ground for

rejecting the prayer made in the instant application for leave to appeal.

We have otherwise perused both the aforesaid orders and find that no point of law, much less point of law of general public importance is involved in

our order dated 28.03.2019 passed in O.A. No. 464 of 2019 and order dated 29.05.2019 passed in R.A. No. 11 of 2019 in O.A. No. 464 of 2019 for

grant of leave to appeal as asked for. Hence, prayer for leave to appeal stands declined.

M.A. No. 2369 of 2019 stands disposed of accordingly.
