This is an application for condonation of delay for restoration of WP(C) No. 510 of 2019, which was dismissed in default on 02.03.2021. The period of delay as shown in the application, and as noted by the Registry is 567 days.
When the matter is called out today, there is no appearance on behalf of the petitioner/applicant. It is noted that by order dated 02.03.2021, when the matter was dismissed this Court had recorded as follows:-
“This petition was placed for admission on 07-12-2020, On that day none appeared for the petitioner. Thereafter, this Court passed the following order: -
“None appears for the petitioner.
Mr. N.D. Chullai, AAG as well as Mr. P. Yobin, learned counsel are present for the respective respondents.
By way of indulgence to the petitioner, stand over to 02-03-2021.”
Today the matter was called out in first round. However, none appeared on behalf of the petitioner, therefore, it was kept back. On second call also nobody appears on behalf of the petitioner. It seems that the petitioner is not interested in prosecuting this petition.
Petition is, therefore, dismissed in default.”
Due care has been taken by this Court to afford adequate opportunities to the petitioner to make appearance, which was however not availed off. Today also none appears on behalf of the petitioner/applicant.
This Misc. application is replete with errors and defects, which are however not gone into. It appears that the petitioner/applicant is not interested even in appearing in the instant restoration application, as such the same is dismissed.
