By way of this writ petition, the petitioner, who is a Forest Contractor, has made a prayer directing the respondents to consider his application dated
13.07.2020, (Annexure P-6) seeking permission for registration of Imported Wood Sale Depot.
Learned Counsel for the petitioner submits that the petitioner had made application dated 13.07.2020 (Annexure P-6) requesting for registration of
Imported Wood Sale Depot, but till today even after completing all the codal formalities, the same has not been considered by the respondents. Hence,
the petitioner has filed this writ petition seeking direction to the respondents to consider his application (Annexure P-6).
On the other hand, learned Deputy Advocate General submits that in case the petitioner fulfills all the mandatory requirements/codal formalities for
granting permission for registration of Imported Wood Sale Depot, the application of the petitioner shall be considered by the respondents.
We have heard learned Counsel for the parties and have also perused the entire record carefully.
It transpires from the record that the petitioner had made application dated 13.07.2020, (Annexure P-6) seeking permission for registration of
Imported Wood Sale Depot. The petitioner has averred in his petition that he has already fulfilled all the mandatory requirements/codal formalities
which were required for the allotment/registration of Imported Wood Sale Depot, but even then till today, his application has not been considered by
the respondents. It appears that the application was made by the petitioner on 13.07.2020 and this petition was filed before this Court on 14.07.2020.
The respondents were required sufficient time to verify all the mandatory requirements. It is not expected that a writ petition be filed before this Court
immediately after making such an application.
Be that as it may. In the facts and circumstances of the case, we deem it proper to dispose of this writ petition directing respondent No. 3 to
examine the application of the petitioner, dated 13.07.2020 (Annexure P-6) and pass appropriate orders, after verifying whether the petitioner has
completed all the codal formalities, within a period of three weeks from today. Ordered accordingly.
The petition is accordingly disposed of along with pending applications, if any.
