Milap Chandra, J.—The case of the petitioner is that an appeal u/s 35B, Central Excises & Salt Act, 1944 has been filed before the Customs, Excise & Gold (Control) Appellate Tribunal, New Delhi against the order of the Collector, Central Excise, Jaipur dated 2nd February, 1994. Two applications, one for waiving the condition of deposit of the amount of excise duty imposed as required u/s 35F of the Act and the other for the stay of the recovery of the amount of duty imposed till the disposal of the appeal itself, have been moved in the said appeal. His further case is that these two applications are not being disposed of and the proceedings for the recovery of the excise duty imposed have been started vide Annexure 5.
