One Abdul Suban lodged a complaint with the jurisdictional police on 28.06.2010 stating that his son Rahamatulla committed suicide and in the death note left behind by him, the names of the petitioners are mentioned as the reason for committing suicide. The jurisdictional police registered a case in Crime No. 154/2010 for the offence punishable u/s 306 of IPC. The investigation is completed and the charge sheet is filed. Now the matter is pending before the Fast Track Court in SC No. 107/2011. At this stage, petitioners are before this Court to quash the proceedings u/s 482 of Cr.P.C. mainly on the ground that the averments made in the death note do no constitute an offence u/s 306 of IPC. The Investigating Agency collected evidence and filed the charge sheet. At this stage, it is not appropriate for this Court to screen or assess the evidence collected by the Investigating Agency. All contentions are left open. The Fast Track Court to expedite the matter. It is also open for the petitioners to file an application for discharge before the Fast Track Court and in such an event, the same to be considered in accordance with law.

Accordingly, the petition is hereby dismissed.
