19.05.2025: IA No. 1595 of 2025- This is an application seeking condonation of delay in filing the present appeal. There is a 41 days’ delay in filing the present appeal. The reasons for delay are mentioned in paragraph no. 2 of the application. The Ld. Counsel for the Respondent does not raise any objection for allowing the application.

Considering the submission made in paragraph 2 of the application, delay stands condoned.

Comp. App. (AT) No. 62 of 2025

This appeal is against an interim order dated 18.10.2024 whereby due to non-appearance of the appellant, the interim stay which was being continued till that day in favour of the appellant, was vacated.

It is submitted by the Ld. Counsel for the appellant the matter was listed on 04.10.2024 when it was adjourned to 14.11.2024. However, when the appellant appeared on 14.11.2024 he came to know that on 18.10.2024 the interim stay granted on 17.05.2024 and operating in favour of the appellant stood vacated.

Vide order dated 11.03.2025, we extended the interim stay granted on 17.05.2024 by the Ld. NCLT, Mumbai Bench till today.

It is the submission of the Ld. Counsels appearing on both sides now since Comp. Appl/91(MB)2025 seeking same relief as in this appeal is listed before the Ld. NCLT on 30.05.2025, hence it would be appropriate if this appeal is disposed of with a request to the Ld. NCLT to take up the said application on the said date of hearing and to dispose it off on merits. Ordered accordingly.

Interim stay granted on 11.03.2025 by this court shall stand extend till the date of the order on such application (Comp. Appl/91(MB)2025).

With these observations, the appeal stands disposed of. Pending applications also stand disposed of.
