The petitioner has filed the present petition for directing the respondents to appoint him as RET against the available post in Govt. Girls Middle School, Jallian being higher in merit than the private respondent No. 5. Prayer has also been made not to approve/recommend the name of the private respondent No. 5 as RET in Govt. Girls Middle School Jallian.

Mr. Raman Sharma, learned AAG and Mr. Bishamber Dass, CEO Poonch has produced the record.

A perusal of order dated 24.01.2004 issued by the ZEO, Mandi Poonch reveals that the respondent No. 5 has been engaged as RET in Govt. Girls Middle School Jallian. More so, from the record it is evident that the petitioner too has been appointed as RET in Government Middle School, Makroo vide order dated 20.10.2010 and thereafter he was regularized as teacher vide order dated 09.04.2016.

In view of this, nothing survives in the present petition for adjudication by this Court and the present petition is accordingly dismissed as having been rendered infructuous.

At this stage, learned counsel for the petitioner seeks liberty to challenge the order of engagement of private respondent No. 5 and subsequent order of his regularization. Needless to say that no such liberty is required to be granted to the petitioner.
