01/ Learned counsel for the applicant submits that the applicant has completed his Ph.D from Jamia Millia University for Higher Studies, New Delhi. The applicant prays for post facto sanction of his Study Leave of 03 months with effect from 01-03-2018 to 23-05-2018 as mentioned in the letter dated 12-12-2018 issued by respondent No.4. Learned counsel further submits that in this regard, the applicant has filed a representation dated 23-08-2022 before the respondents. However, after arguing for a while, learned counsel submitted that the applicant will feel satisfied if the respondents are directed to consider the said representation in the light of Circular No. 10-Edu of 2021 dated 21-09-2021, paragraph 2nd whereof is reproduced herein below :
“Therefore, to avoid the chaotic and messy situation arisen in the Department and to streamline the system, the post-facto permission for obtaining higher qualification is abolished henceforth. The cases of candidates who have joined the course up to 31-12-2020 shall only be considered as per merits. No case shall be entertained where admission to the course started from 01-01-2021 onwards.”

03/ In view of the limited prayer made by the counsel for the applicant, this OA is disposed of with the direction to the respondents to consider the representation of the applicant dated 23-08-2022 in terms of rules governing the field especially taking into account the Circular aforementioned. Needful to be done within six weeks to be reckoned from the date copy of this order is served on them.
04/ In the backdrop of discussion supra, this OA 456/2023 shall stand disposed of.
