Judgment
The present petition has been filed under Section 29A of the Arbitration and Conciliation Act, 19961 seeking extension of the mandate of the learned Arbitrator.
The dispute between the parties arises out of the acquisition of the Petitioner’s land for the purpose of construction/development of NH-344M.
Aggrieved by the compensation awarded, the Petitioner invoked arbitration under Section 3G(5) of the National Highways Act, 1956 seeking enhancement of the compensation awarded.
Learned Counsel for the Petitioner submits that pleading before the erstwhile learned Arbitrator stood completed. However, pursuant to the appointment of the Secretary (Land and Building) as the new arbitrator vide order dated 28.07.2023, the proceedings were transferred to the Land and Building Department, I.T.O, New Delhi.
Learned Counsel for the Petitioner submits that after the transfer of the proceedings, the learned Arbitrator observed that his mandate had expired, and therefore, the arbitral proceedings could not proceed unless the mandate gets extended by this Court.
Issue notice.
Notice is accepted by Ms. Ramya S. Goel, learned Counsel appearing for the Respondent on advance notice.
Learned Counsel for the Respondent has no objection against the extension of the mandate.
In view of the joint request of the parties, the mandate of the learned Sole Arbitrator is extended by a further period of six months from today. The intervening period till today shall also stand regularised.
Accordingly, the petition is disposed of in above terms.
