The petitioner is Information Officer in the respondent-department and is due for promotion to the post of Deputy Director. The vacancy had become available on the retirement of respondent No. 3 on 1.6.2012, but 3rd respondent has been re-employed and posted as Press Secretary to Hon''ble the Chief Minister. By means of the present petition, the petitioner has sought the direction to respondents No. 1 and 2 to initiate the process to fill-up the post of Deputy Director by promotion and also that the re-employment of 3rd respondent after his retirement as Press Secretary to the Hon''ble Chief Minister is wrong and illegal.

In fact re-employment of 3rd respondent does not effect the prospectus of the promotion of the petitioner, but however, Shri. A.K. Bansal, learned Additional Advocate General, on the instructions of the respondents stated that the D.P.C. shall be convened in the time bound manner as would be directed by this Court for filling up the vacancy if any occupied by respondent No. 3.

In view of the assurance given by the learned Additional Advocate General, there shall be direction to the respondents to hold D.P.C. for filling-up such vacancy of Deputy Director on or before 15th October, 2012. These directions be complied with in its letter and spirit. However, it shall be open to the petitioner to approach this Court, if he has any grievance.

With the aforesaid directions, the petition stands disposed of, so also the pending application(s), if any. Authenticated copy of this judgment be supplied to the Learned Counsel for the parties.
