The writ petition is filed with the following prayers:

1 That the writ in the nature of mandamus may kindly be issued directing the respondents to extend the benefit of merger of 50% dearness allowance with basic pay as per letter dated 10.06.2005 to the petitioner.

2.

That the writ in the nature of mandamus may kindly be issued directing the respondents to pay the due and admissible arrears to the petitioners in view of judgment dated 17.11.2009 rendered in CWP(T) No. 14228 of 2008 titled as Nek Ram vs. State of H.P. and justice be done.

CWP No. 1682 of 2012-I

The writ petition is filed with the following prayers:

That the respondents may very kindly be directed to extend the benefit of the judgment passed by this Hon''ble Court in Nek Ram & Ors. vs. State of H.P. & Others, CWP(T) No. 14228 of s2008, decided on 17.11.2009, Annexure P-1 to the petitioner forthwith with all consequential benefits.

It is submitted that a similar issue has been considered by this Court leading to the judgment in Nek Ram and others vs. State of H.P. & Ors., CWP(T) No. 14232/2008, decided on 17.11.2009. It is also submitted that the judgment has been implemented and it has attained finality.

The writ petitions are hence disposed of directing the respondents competent authority to examine the case of the petitioners herein and extend similar treatment to them also as extended to the petitioners in the judgment referred to above in case they are similarly situated to the petitioners in the judgment referred to above. The needful shall be done within a period of four months from the date of production of a copy of this judgment alongwith a copy of the judgment referred to above and a copy of the writ petition(s).

Pending application(s), if any, also stands disposed of.
