Judgment
Mr. Amit Bagga, complainant appeared in person. Advocate Mansi Bajaj and Advocate Nidhi Tyagi appeared on behalf of the Respondents.
Complainant submitted that the shop purchased by him in auction from DDA measures 07 sq.mts. as against 13.05 sq.mtrs. area mentioned in DDA’s tender document and possession letter. He requested for refund of money on pro-rata basis.
Ld. Counsels for Respondents stated that the Complainant out of his freewill took possession of the shop acknowledging the total plinth area and common area of 13.05 sq. mtrs. She produced possession slip dated 27.09.2021 as per which Complainant had taken possession of the Shop Unit No.33, Sector-13 (G.F.) having total plinth and common area of 13.05 sq.mtrs. under scheme CSE No.9, Sector-13, Rohini.

Ld. Counsels for Respondents further submitted that their client would have considered refunding the amount if such a request was made by the Complainant before taking over the possession.
