Judgment
The petitioner is seeking regular bail in FIR No.191
dated 17.02.2017 under Sections 399, 402 of IPC and Sections
25 / 54 / 59 of Arms Act, registered at Police Station City Panipat,
District Panipat.
Learned counsel for the petitioner contends that the
allegations against the petitioner are that he along with others
were preparing to loot a Petrol Pump. He further contends that
only pipe type of stick measuring 3.3 feet has been recovered
from the petitioner. The petitioner is 66 years of age and is
physically handicapped as he is having only one arm. He is in
custody since 17.02.2017.
Learned State counsel states that the charges have
been framed in the case and the matter is fixed before the trial
Court for examination of witnesses on 04.09.2017.
Heard.
The petitioner is a physically handicapped person of 66
years of age and only a stick has been recovered from him. He is
in custody for almost 6 months. The trial will take some time to
conclude. Therefore, I deem it to be a fit case to grant him the
concession of regular bail.
Without expressing any opinion on the merits of the
case, the instant petition is allowed. The petitioner, namely, Sewa
Ram is ordered to be released on bail on his furnishing requisite
bonds to the satisfaction of the trial Court/Duty Magistrate.
